Brits – A legal battle between ANC-linked businessman Solly “MySol” Madibela and Economic Freedom Fighters Chairperson in Madibeng, Simon Maebane, took a dramatic turn at the Brits Magistrate Court on 26 August 2026.
The dispute stems from directives issued by the Department of Mineral Resources and Energy, which instructed Samancor to ensure it takes care of communities where it mines in the Madibeng Local Municipality. MySol, whose company MySol operates under Samancor in Brits, is accused of refusing to adhere to those directives.
According to sources, Maebane challenged Madibela to comply with the departmental directives on behalf of the affected communities.
In response, Madibela allegedly filed for a protection order against Maebane, citing harassment and intimidation. Maebane opposed the interdict, which Madibela reportedly then refused to sign.
When the matter was brought before the Brits Magistrate Court yesterday, proceedings could not continue due to a lack of supporting documents from Madibela’s side. The magistrate postponed the matter to 15 September 2026.
However, it was the events surrounding the court appearance that sparked outrage from the EFF.
Maebane’s legal team raised three concerns in court:
- That Madibela was allowed to use administration parking reserved only for court officials and the South African Police Service.
- That EFF leaders were allegedly refused entry into the court for wearing EFF party regalia, despite there being no law prohibiting it.
- That members of the Klipgat Public Order Policing (POP) unit harassed peaceful EFF members who had gathered outside the court in support of Maebane, even though they were not obstructing traffic.
The presiding magistrate is said to have apologized for the irregularities raised.
Addressing supporters outside court after the postponement, Maebane claimed the case was politically motivated.
“I believe this is politically motivated because ANC in Madibeng has lost touch with the people and EFF is doing service delivery for people while not in government,” Maebane said.
Afrimerits News has reached out to Solly Madibela for comment. His response will be included once received. The Department of Mineral Resources and Energy is also yet to comment on the implementation of its directives in the area.
The case returns to court on 15 September 2026.
